An FTT Application was been made by former directors Ray Robson and Jayne Smith and her husband Richard Smith.
Application LON/00AD/LSC/2019/0240 was defended by the Company at the not inconsiderable considerable cost of around £22,000 and was ultimately withdrawn by the applicants before the hearing. The huge costs arose due to the near 1,000 pages of information submitted which was largely irrelevant to the reason the applicants brought the FTT for "Determination of Liability to Pay and Reasonableness of Service Charges". Despite the Judge at the Case Management Conference instructing the Applicants to detail the expenditure they considered unreasonable in the period 2012 to 2019 only 2 items were listed in their statement of case, one from 2013 and one from 2014. The one from 2014 was not even service charge expenditure and the Company had already considered the 2013 item and were satisfied it was expenditure reasonably incurred. Mr Robson was a director in 2013 and signed the 2013 Service Charge Accounts
Rather than focus on why there was a 16% overspend in 2014 the years 2012 to 2019 were included and the pre-hearing focus was on the works carried out by Ken Wilson from 2016 on despite the fact that the amounts invoiced for identical or similar works were substantially lower than those authorised in 2014 by the previous Managing Agent's Block Management Department.
